Default No more tax free housing for USian religion?

This could well be a big deal.

US court declares tax breaks for ministers houses unconstitutional.

This has been going on for a while, the ruling ties in with the Johnson amendment exception given to religions but not other non-profits.


Basically it comes down to, if you give a certain group privileges over another group who are for all intents and purposes performing the same service then it's unconstitutional, regardless of whether it's a religious group or not. In other words you can't discriminate based on religion, whether that discrimination is to the benefit or detriment of said religious group.


It should get interesting if that same principal is applied to the Johnson Amendment, although it will require a secular non-profit to throw itself under the knife to show they have cause to bring the case. At the moment religious groups are exempt from the Johnson Amendment in that the IRS has been told not to press charges for breaching it, so while at the moment the "wording" applies to all non-profits, not all non-profits are being treated the same in law, a clear violation of the constitution.


I will get myself some popcorn for this one I think.
